Terms of Service

These Terms of Service ("Terms") are a legally binding agreement between you and WorkGist ("WorkGist", "we", "us" or "our"). They govern your access to and use of the website at getworkgist.com, its sub-domains, and any related applications, features, content and services we offer (together, the "Service").

Please read these Terms carefully. By creating an account, posting a contribution, claiming an employer page, or otherwise using the Service, you confirm that you have read, understood and agree to be bound by these Terms, our Privacy Policy and our Cookie Policy, which form part of these Terms. If you do not agree, you must not use the Service.

1. About WorkGist

1.1. WorkGist is an online platform on which current and former employees and job candidates share anonymous information about workplaces in Africa, including company reviews, reviews of managers identified only by their role, interview experiences, salaries, questions and answers, workplace news reports and poll answers.

1.2. WorkGist is built around anonymity. We never display the name, contact details or account of the person who wrote a contribution. Section 6 explains how anonymity works and where its limits are.

1.3. WorkGist is an independent platform. We are not affiliated with, endorsed by or acting for any employer listed on the Service, unless we say so expressly.

2. Definitions

In these Terms:

  • "Account" means the account you create to use member features of the Service.
  • "Contribution" means any content you submit to the Service, including reviews, ratings, red and green flags, manager reviews, interview experiences, salary information, questions, answers, workplace news reports and confirmations, poll votes, "Helpful" votes, reports and employer replies.
  • "Employer" means an organisation that is listed on the Service, whether or not it has an Employer Account.
  • "Employer Account" means an account through which an authorised representative of an Employer manages that Employer's page under section 12.
  • "Member" means a person who has an Account.
  • "Personal Data" has the meaning given in the Privacy Policy.
  • "Visitor" means a person who uses the Service without logging in.

3. Who may use the Service

3.1. You must be at least 18 years old and able to enter into a binding contract under the law that applies to you to create an Account or post a Contribution. Visitors under 18 must not use the Service.

3.2. You may hold only one personal Account. You must not create an Account on behalf of someone else, or create or use an Account to post on behalf of an Employer, except an Employer Account under section 12.

3.3. You must not use the Service if we have previously suspended or terminated your Account, or if you are barred from receiving the Service under the law of any country that applies to you.

4. Your Account

4.1. Logging in. We do not use passwords. You log in with a one-time code sent by SMS to your phone number or by email to your email address, or with Google. Each code works once and only for a limited time.

4.2. Keep your login methods secure. You are responsible for keeping control of the phone number, email inbox and Google account you use to log in, and for all activity under your Account. Never share a login code with anyone, including anyone claiming to work for WorkGist. We will never ask you for a code.

4.3. Tell us about misuse. If you believe someone else has accessed your Account, log out on all devices from your Account page and contact us at support@getworkgist.com without delay.

4.4. Accurate details. The phone number or email address you use must be one you are entitled to use. We use it only to log you in and to secure your Account, as described in the Privacy Policy. It is never shown on your Contributions.

4.5. Closing your Account. You may delete your Account at any time from your Account page. When you do, your login details are deleted. Your Contributions remain on the Service in anonymous form unless you choose to remove them at the same time (see section 9.4).

5. What you may do on the Service

5.1. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own non-commercial purposes, such as researching employers, comparing salaries and sharing your own workplace experience.

5.2. Some features are available only to Members, including posting Contributions, following companies, voting in polls, marking content "Helpful", asking and answering questions, reporting content and seeing all salary ranges.

5.3. Give-to-get. Some information, such as the full set of salary ranges, may be unlocked only after you have posted at least one approved Contribution. We may change which features are unlocked in this way.

6. Anonymity and its limits

6.1. What we promise. We do not display your name, phone number, email address, Google profile, Account identifier or any other login detail on your Contributions, in search results, in share images or share text, or to Employers, including Employers who pay us. Managers are shown only by their role, never by name.

6.2. Minimum numbers. To reduce the risk that a contributor can be identified, we do not show a company's rating or its reviews until it has at least five approved reviews, and we do not show a salary range for a role until it has at least five salaries. We may apply further thresholds and rounding.

6.3. What you control. Anonymity also depends on what you write. A Contribution that mentions details only you or a few people would know (for example your exact job title in a small team, a unique incident, specific dates, or your own name) may allow others to identify you. You are responsible for the content of your Contributions. We may remove or ask you to change details that could identify you or others, but we are not obliged to.

6.4. Legal limits. We will not disclose who wrote a Contribution unless we are compelled to do so by a valid, legally binding order of a court or authority of competent jurisdiction, or where disclosure is necessary to prevent a serious and imminent threat to a person's life or safety. Where the law allows, we will challenge requests we consider unlawful or excessive, disclose only the minimum information required, and tell the affected Member before disclosing so that they can seek legal advice. Section 8 of the Privacy Policy explains this in more detail.

6.5. No attempts to unmask. You must not try to identify the author of any Contribution, including by combining information on the Service with other information, by contacting other Members to ask them to reveal themselves, by analysing writing style, or by any technical means.

7. Contribution rules

7.1. Honest, first-hand and relevant. Every Contribution must be honest and reflect your own genuine, first-hand experience as a current or former employee, contractor, intern or job candidate of the Employer concerned, and must be accurate to the best of your knowledge. Salary information must be your own actual pay. Workplace news reports must describe events you reasonably believe to be true.

7.2. You must not post a Contribution that:

  • names, describes or otherwise identifies any individual, including managers, colleagues, recruiters or customers, other than by a general job role;
  • includes anyone's personal data, such as phone numbers, email addresses, home addresses, photographs, ID numbers, health information or details about their private life;
  • is false or misleading, or that you know or suspect to be untrue, including a statement presented as fact that harms the reputation of a person or Employer;
  • discloses trade secrets, confidential business information, unreleased financial results, or information you are bound by law or contract to keep confidential, other than information you are legally protected in disclosing;
  • is abusive, threatening, harassing, hateful or discriminatory, including on grounds of ethnicity, tribe, religion, gender, sexual orientation, disability, age, nationality or political opinion;
  • is sexually explicit, violent, or promotes illegal activity;
  • infringes anyone's copyright, trademark, privacy or other rights;
  • is written about an Employer you own, manage or work for in human resources, communications or recruitment, or about a competitor, or in return for any payment, gift, job, favour or other incentive;
  • is posted on behalf of someone else, or is one of several Contributions about the same experience;
  • contains advertising, spam, links to other sites, or attempts to recruit or solicit;
  • contains malware, or is designed to interfere with the Service; or
  • otherwise breaks the law of the country where you are, where the Employer operates, or where we operate.

7.3. Questions and answers. Questions must be about working at the Employer concerned. Answers must be based on your own knowledge of that Employer.

7.4. Reports. You must not misuse the reporting features, for example by reporting content you know does not break these Terms or by co-ordinating reports.

8. Moderation

8.1. How we review. We may review Contributions before or after they are published, using a combination of automated tools and human moderators. Contributions appear publicly only once approved.

8.2. What we may do. We may, at our discretion and without liability, decline to publish, remove, hide, limit the visibility of, or redact any part of a Contribution that we reasonably believe breaks these Terms or the law, puts anyone at risk, or could identify a contributor or another person. We do not otherwise change the meaning of your Contributions.

8.3. No obligation to monitor. We are not obliged to monitor the Service and do not guarantee that all content complies with these Terms. Contributions are the views of their authors, not of WorkGist.

8.4. Appeals. If we remove your Contribution, we will tell you where we can, and you may appeal through the Service or by writing to support@getworkgist.com within 30 days. A different moderator will review the appeal. Our decision on an appeal is final, without affecting any rights you have under applicable law.

8.5. Employers cannot moderate. Employers, including those with paid Employer Accounts, cannot edit, delete, hide or reorder Contributions and cannot see who wrote them. Employers may report a Contribution under section 13 in the same way as anyone else.

9. Your Contributions and the licence you give us

9.1. You keep ownership. You keep any intellectual property rights you have in your Contributions.

9.2. Licence to us. By submitting a Contribution, you grant WorkGist a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, transferable and sub-licensable licence to host, store, reproduce, adapt (for formatting, translation, redaction and moderation), publish, display, distribute and otherwise use the Contribution, in whole or in part and in any media, in connection with operating, providing, improving and promoting the Service, including in share images and in aggregated statistics such as ratings, rankings and salary ranges.

9.3. Moral rights. To the extent permitted by law, you waive, and agree not to assert, any moral rights you may have in your Contributions, including the right to be identified as their author, so that we can keep them anonymous.

9.4. After you leave. If you delete your Account, your Contributions stay on the Service, anonymous and no longer linked to you, so that they continue to help others, unless you choose "Also remove all my posts" when you delete your Account or ask us to remove them. Aggregated statistics that have already been calculated from a Contribution, and copies other people have already shared, may not be reversed.

9.5. Your promises. For each Contribution you promise that it follows section 7, that you have all the rights needed to grant the licence in section 9.2, and that our use of it as permitted by these Terms will not infringe anyone's rights or break any law.

10. Ratings, statistics and rankings

10.1. Ratings, flag counts, salary ranges, poll results, rankings and similar figures on the Service are calculated from Contributions and other data using our own methods, which we may change. They are indications based on what Members have shared, not verified facts.

10.2. Rankings are positive only. We do not publish lists of the worst employers.

10.3. "Verified" labels mean that we took reasonable steps to check a contributor's link to an Employer, for example through a work email or a document. They are not a guarantee.

11. Workplace news, polls and sharing

11.1. Workplace news reports are shown publicly only after enough Members have confirmed them and only for a limited period. Confirming a report means you believe it to be true from your own knowledge.

11.2. You may share pages, Contributions and images from the Service using our share features. Share images and share text never include information that identifies a contributor. You are responsible for where you share them and for any comments you add.

12. Employer Accounts

12.1. Claiming a page. An authorised representative of an Employer may claim that Employer's page by verifying a work email address on the Employer's domain or by providing documents that we accept as proof of authority. You promise that you are authorised to act for the Employer and that the information you give us is true. We may refuse or revoke any claim.

12.2. What Employers can do. An Employer Account may update the Employer's profile information, publish replies to Contributions, and use any additional features of the plan it is on. Employer replies are public, must follow section 7 as if they were Contributions, and are moderated in the same way.

12.3. What Employers cannot do. Employers and their representatives must not, and the Service will not allow them to: edit, delete, hide, reorder or delay any Contribution; learn or attempt to learn who wrote any Contribution; offer, request or reward reviews; ask employees or candidates to post, remove or change Contributions; or retaliate against or disadvantage anyone they believe has posted, reported or confirmed content. Breach of this section is a serious breach of these Terms.

12.4. Paid plans. Some Employer features are offered on a paid subscription ("Pro") at the price shown on the Service. Paid plans are subject to the plan terms shown at the time of purchase, which will set out the billing period, renewal, cancellation and refund terms. Paying us never gives an Employer any control over Contributions or access to contributor identities.

12.5. Responsibility. The Employer is responsible for everything done through its Employer Account and for ensuring its representatives comply with these Terms.

13. Reporting content and notice-and-takedown

13.1. Anyone, whether or not they have an Account, may report content they believe is unlawful or breaks these Terms, including content they believe is defamatory, infringes their intellectual property, or discloses their personal data. Members can use the "Report" button. Anyone can write to legal@getworkgist.com.

13.2. A notice should include: your name and contact details; the link to the content; the specific words or material you object to; why you believe it is unlawful or breaks these Terms, including any facts showing it is untrue where you allege defamation; for intellectual property claims, details of the right you own; and a statement that the information in your notice is accurate and made in good faith.

13.3. We will acknowledge notices within a reasonable time, review them promptly, and act in line with applicable law, including the notice-and-takedown procedures of the countries in which we operate. We may restrict content while we review it. Where appropriate and safe, we will give the author an opportunity to respond, without revealing the author's identity to the person who reported the content.

13.4. Submitting a notice you know to be false or misleading may make you liable for damages.

14. Our intellectual property

14.1. The Service, including its software, design, text written by us, graphics, logos, the WorkGist name and the compilation of content on the Service, is owned by or licensed to WorkGist and is protected by intellectual property laws. Except for the licence in section 5.1, these Terms give you no rights in it.

14.2. If you send us feedback or suggestions, we may use them freely without any obligation to you.

15. Acceptable use

You must not, and must not help anyone else to:

  • copy, scrape, crawl, harvest or index any part of the Service by automated means, or build a database or competing service from it, except for search engines;
  • reverse engineer, decompile or attempt to obtain the source code of the Service, except where the law allows this despite this restriction;
  • probe, scan or test the security of the Service without our written permission, or bypass any security, rate limit, access control, minimum threshold or give-to-get control;
  • attempt to re-identify any person from Contributions, aggregated statistics or share images;
  • access the Service with someone else's Account or login code, or sell, transfer or lend your Account;
  • use the Service to send unsolicited messages or to collect information about other Members;
  • interfere with or overload the Service; or
  • use the Service in any way that breaks the law or these Terms.

16. Third-party services

16.1. The Service relies on third-party providers, for example to host our systems and data, send login codes by SMS and email, and provide "Continue with Google". Your use of a third-party service such as your Google account is also governed by that provider's terms and privacy policy.

16.2. The Service may contain links to websites we do not control. We are not responsible for their content or practices.

17. Disclaimers

17.1. Contributions are the opinions and experiences of individual Members. We do not verify the truth of every Contribution and do not endorse any of them. You should not rely on the Service as your only source of information when making decisions about employment, salary or careers.

17.2. Nothing on the Service is legal, financial, tax, immigration or employment advice.

17.3. To the fullest extent permitted by law, the Service is provided "as is" and "as available", without any warranty of any kind, whether express or implied, including any warranty of accuracy, availability, fitness for a particular purpose or non-infringement. We do not promise that the Service will be uninterrupted, secure or free of errors.

17.4. Nothing in these Terms excludes or limits any warranty, right or remedy that cannot lawfully be excluded or limited, including your rights as a consumer under the law of the country where you live, such as the Federal Competition and Consumer Protection Act 2018 of Nigeria, the Consumer Protection Act 2012 of Kenya and the Consumer Protection Act 68 of 2008 of South Africa, to the extent they apply.

18. Limitation of liability

18.1. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.

18.2. Subject to section 18.1, WorkGist will not be liable to you, whether in contract, delict or tort (including negligence), breach of statutory duty or otherwise, for any loss of profit, revenue, business, opportunity, goodwill or data, or for any indirect or consequential loss, arising out of or in connection with the Service or these Terms.

18.3. Subject to section 18.1, WorkGist is not liable for Contributions or other content posted by Members or Employers, or for any decision you make based on them.

18.4. Subject to section 18.1, our total liability to you arising out of or in connection with the Service or these Terms in any 12-month period is limited to the greater of (a) the total amount you paid us in that period, and (b) ₦100,000 (one hundred thousand Naira) or its equivalent in your local currency.

19. Indemnity

To the extent permitted by law, you agree to indemnify WorkGist, its officers, employees and agents against any claims, losses, liabilities, damages, costs and expenses (including reasonable legal fees) arising out of your Contributions, your breach of these Terms, or your breach of any law or the rights of any third party. This section does not apply to the extent a loss is caused by our own breach of these Terms or our negligence.

20. Suspension and termination

20.1. We may suspend or terminate your Account or your access to all or part of the Service, with or without notice, if we reasonably believe that you have broken these Terms or the law, that your use puts other people or the Service at risk, or if we are required to do so by law. Where it is safe and lawful, we will tell you why.

20.2. You may stop using the Service and delete your Account at any time.

20.3. Sections 6.4, 6.5, 9, 14, 17, 18, 19, 22 and 23, and any other provision that by its nature should survive, survive the end of these Terms.

21. Changes to the Service and these Terms

21.1. We may change, suspend or discontinue any part of the Service at any time.

21.2. We may update these Terms from time to time. If a change materially affects your rights, we will give you at least 30 days' notice through the Service or by message to your login email or phone before it takes effect, unless the change is required by law or is needed urgently to protect the Service or its users. If you continue to use the Service after a change takes effect, you accept the updated Terms. If you do not agree, you may delete your Account.

22. Governing law and disputes

22.1. These Terms and any dispute or claim arising out of or in connection with them or the Service, including non-contractual disputes, are governed by the laws of the Federal Republic of Nigeria.

22.2. Before starting any formal proceedings, you and WorkGist agree to try to resolve any dispute informally by writing to the other party and negotiating in good faith for at least 30 days. You can reach us at legal@getworkgist.com.

22.3. Any dispute not resolved under section 22.2 shall be referred to and finally resolved by arbitration under the Arbitration and Mediation Act 2023 of Nigeria and the Arbitration Rules of the Lagos Court of Arbitration in force at the time. The seat of arbitration shall be Lagos, Nigeria, the tribunal shall consist of one arbitrator, and the language shall be English.

22.4. Nothing in this section prevents either party from seeking urgent interim relief from a competent court, prevents you from bringing a claim in a small claims court or consumer tribunal where you live if that court or tribunal has jurisdiction, or removes any right you have as a consumer to bring proceedings in the courts of the country where you live.

23. General

23.1. Entire agreement. These Terms, the Privacy Policy, the Cookie Policy and any plan terms you accept form the entire agreement between you and WorkGist about the Service.

23.2. Severability. If any provision of these Terms is found invalid or unenforceable, the rest remains in full force, and the provision will be applied to the greatest extent permitted.

23.3. No waiver. If we do not enforce a right straight away, we may still enforce it later.

23.4. Assignment. You may not transfer your rights or obligations under these Terms. We may transfer ours to another organisation, for example as part of a merger or sale of the business, provided your rights under these Terms and the Privacy Policy are not reduced.

23.5. Events outside our control. We are not responsible for any delay or failure caused by events beyond our reasonable control.

23.6. Third-party rights. No one other than you and WorkGist has any right to enforce these Terms.

23.7. Language. These Terms are written in English. Any translation is for convenience only, and the English version prevails.

23.8. Notices. We may give you notices through the Service or by message to the email address or phone number you use to log in. You may give us notices at legal@getworkgist.com.
